Treaty of Peace and Friendship between Japan and China Negotiations (16th Meeting)

No. 1643 Secret Top Urgent

The 16th meeting took place on the 11th for 35 minutes, from 10:20 until 10:55. The give and take in this meeting is as follows. (The participants and venue were the same as at the 15th meeting.)

1. At the start, I asked to speak. I spoke as follows.

As I said at the 15th meeting, there are two main issues left us. The first issue is the now-famous issue of “opposes” and “is opposed to.” The Japanese side in regard to this issue agrees with the view of the Chinese side. Accordingly, we make this text “opposes.” The second issue is one about which I would like to have the Chinese side speak, that is to say, the issue of where to put Sentence 1 of the hegemony article.

2. In reply, Vice Minister Han replied as follows:

We agree to making Sentence 1 of the anti-hegemony article an independent article, per the Japanese side’s proposal. Accordingly, Sentence 1 of the anti-hegemony article becomes Article 4. The Chinese side’s draft Article 4 from yesterday, “The Contracting Parties shall consult on important international issues of common or mutual interest,” will be removed. To repeat, Sentence 1 of the anti-hegemony article will be made the new Article 4.

3. In response to this, I asked emphatically, “Accordingly, the provision on the treaty’s termination becomes Article 5, right?” Vice Minister Han then confirmed that it was so.

4. Continuing, I said: “With this, the work between Vice Minister Han and me is over. I would like to leave the other issues remaining to the drafting committee.” Vice Minister Han then replied, “Fine.”

5. Next, I said, “The Japanese side will not announce to the outside that the treaty negotiations are finished until the drafting committee’s work is complete. I would like to wait on announcing to the outside until the committee’s work is finished. The Vice Minister then agreed with the Japanese side’s thinking: “The Chinese side, too, will not announce the treaty negotiations have ended until the committee’s work is over.

6. Next, Bureau Director-General Omori asked to speak and, per separate telegram, asked the Chinese side about its thinking concerning the Sino-Soviet Alliance Treaty.

7. Further, after this meeting ended, the drafting committee at once began its work.

 11日午前10時20分より同55分まで35分にわたり、本件第16回会談が行われたところ、同会談における双方のやりとり次の通り。(出席者及び場所は第15回会談に同じ)

1.冒頭、本使より発言を求め、次のとおり述べた。

 第15回会談で述べたとおり、われわれに残された主要問題は二つある。第一の問題は、既に有名になつた「反対する」・「反対である」の問題である。この問題につき、日本側は中国側の意見に同意する。従つて、条文は「反対する」にする。

 第二の問題は、中国側から発言していただかなければならない問題、即ち、は権条項の第1文をどこに置くかという場所の問題である。

2.これに対し韓副部長は、次のとおり述べた。

 われわれは、日本側の提案どおり反は権条項第1文を単独の条項とすることに同意する。従つて反は権条項第1文は新しく第4条となる。昨日の中国側草案第4条「両締約国は、共通の関心を有する、または双方の利益にかかわる重要な国際問題について協議するものとする。」は削除する。もう一度くり返すと、反は権条項第1文の案文を新しく第4条にすることとする。

3.これを受けて本使より「従つて条約発効に関する条項は第5条になりますね。」と念を押したところ、韓副部長は、その通りであるとこれを確認した。

4.引き続き本使より、「私と韓副部長との間のし事は、これで全部済んだ。残された他の問題はドラフテイング・コミテイーに任せたい。」と述べたところ、韓副部長は、「結構である」と答えた。

5.次いで本使より、「日本側は、ドラフテイング・コミテイーのし事が全部完了するまで、外部に対し、条約交渉は終つたと発表しない。外部に対する発表は、同コミテイーのし事が済むまで待ちたい」と述べたところ、同副部長は、「中国側も同コミテイーの作業が終るまで、条約交渉が終つたと発表しない」と日本側の考えに同意した。

6.次いでオオモリ局長より発言を求め、別途電報のとおり、中ソ同盟条約に関する中国側の考えを質した。

7.なお、ドラフテイング・コミテイーは、本件会談終了後直ちにその作業を開始した。
