Excellency:

I have the honor to acknowledge the receipt of your letter of today, which reads as follows:

“ Excellency,

In connection with the signing today of the Agreement between the Federal Minister for Research and Technology of the Federal Republic of Germany and the Atomic Energy Organization of Iran on Co-operation in the Fields of Peaceful Uses of Nuclear Energy and with regard to the contracts to be concluded between the Atomic Energy Organization of Iran and Kraftwerk Union AG on the construction of the nuclear power stations Iran 1 and Iran 2, I have the honour to confirm on behalf of the Federal Minister for Research and Technology that agreement has been reached between the Signatories on the following:

1. The contracts to be concluded between the Atomic Energy Organization of Iran and Kraftwerk Union AG are regarded as special arrangements under Article 1, paragraph 2 of the Agreement.

2. With regard to classified information on safety and protection of the nuclear power stations Iran 1 and Iran 2, to be transmitted in the execution of the above-mentioned contracts from Kraftwerk Union AG to the Atomic Energy Organization of Iran, the necessary approval referred to in Article 5, paragraph 1, lit. b of the Agreement, which will form the basis of the transfer of such classified information, shall be entered into as soon as possible.

3. The Contracting Parties shall consult each other before fissionable nuclear materials, supplied under the contracts mentioned in paragraph (1) above or generated from such materials or by use of the nuclear power stations Iran 1 or Iran 2, are such transferred to third countries. They may agree that such materials may not be transferred to certain countries without the consent of the Government of the Federal Republic of Germany.

In case of a proposed transfer to countries not requiring the consent of the Government of the Federal Republic of Germany, or irradiated fuel for reprocessing, storage, or other services or functions, the Government of the Federal Republic of Germany may indicate a third country willing to perform, on competitive terms and conditions, the services or other functions required. In such cases the transfer shall take place to the country indicated by the German side if such transfer is compatible with normal trade policies of the Imperial Government of Iran.

It is the understanding of the Contracting Parties that also in the case of permanent transfer to a third country, the fissionable nuclear materials mentioned above, except for small quantities that may be destined for laboratory experiments, shall be used only for the fabrication of fuel elements for nuclear power reactors. For that purpose the terms and conditions of such transfer, to be agreed by the Imperial Government of Iran and the third country concerned, will contain appropriate provisions.

I have the honour to suggest that, if the Imperial Government of Iran agrees with the proposals contained in paragraphs (1) to (3), Your Excellency give confirmation to that end by a letter in reply.”
